On 05 September, DG COMP published a Staff Working Document summarising the findings of its evaluation of Regulations 1/2003 and 773/2004 (‘the evaluation’).

 

The evaluation has shown that the Regulations have generally achieved their objective of effective, efficient and uniform application of the EU competition rules. The main changes brought about by Reg. 1/2003, i.e. the removal of the notification system and the implementation of a decentralised system of parallel enforcement are viewed very positively.


The evaluation has also identified certain areas where there is scope for improvement, both in relation to the Commission’s procedures but also in relation to the functioning of the ECN.


EVP Vestager said of the evaluation that:

 

“Regulation 1 ushered in the modern form of EU enforcement. The evaluation highlights this success. It also identifies areas where we can do better... Antitrust investigations take a long time. Our investigative powers could be updated. The procedure for access to the file could be made more efficient. Our decision-making powers should also be considered. There is notable support for increasing the use of interim measures”.
