The new Market Definition Notice  (‘the Notice’) was published by the European Commission on 08 February.

 

The Notice provides new or updated guidance on the key concepts and principles of market definition, including new chapters on issues that have not been covered before.


Market definition is a first step in the assessment of mergers and most antitrust cases, where it is necessary to (self-)assess whether a company holds or is likely to increase its market power.


Bolstered by numerous examples, practitioners hope that the Notice will provide greater transparency, make this assessment even more predictable and accessible, bringing greater legal certainty for firms and their advisers across the EU and beyond.


This should be especially welcome in the increasingly complex and dynamic European markets, for example involving multisided platforms in the digital space, after-markets / bundles and digital ecosystems. 


Participants in this first post adoption 'Chatham House rule' in-person / webinar panel discussion (including extensive Q&As) with the Notice's review team will benefit from understanding the latest thinking in Brussels that underpins nearly all of DG COMP’s future interventions.
