On 19 September, DG COMP published their third Competition Policy Brief so far this year on ‘Competition in Generative AI and Virtual Worlds’ (‘the brief’).

 

The brief looks at emerging trends and current market dynamics in these technologies, and suggests preliminary elements for the analysis of cases, such as possible barriers to entry, theories of harm and efficiency gains


In particular, the brief considers what types of anticompetitive concerns may emerge and the different tools to address them, including antitrust enforcement, merger control as well as the DMA.


Already welcomed by the competition law community for its wide coverage, the brief summarises the Commission’s current thinking on these subjects, building on responses by stakeholders to its call for contributions, studies and inquiries by competition authorities and multiple expert reports.
