After a period of decline, leniency applications to DG COMP continue to rise!


Recently senior COMP officials have also confirmed that:


·        Reversing the most recent trend, the Commission expects to issue more decisions in 2025 including in respect of non-traditional cartels; 

·        Roughly 50% of early-stage cases are now initiated through ex officio investigations, including those conducted with non-EU agencies; 

·        Dawn raids continue to be a key investigatory tool; 

·        Approximately half of all COMP's cartel cases are settled; 

·        COMP continues to expand the toolbox using other non-leniency channels to detect cartels; and 

·        The destruction of (digital) evidence and obstructing investigations will be dealt with severely.

The May 2024 Competition Brief clearly stated that wage fixing and all forms of no-poach agreements should also be considered as a form of purchase price fixing and supply market sharing - i.e. by object buyers’ cartels - explicitly prohibited under Article 101(1) TFEU.


Against this background, Marek Jahudka and Chris Mayock have kindly agreed to answer your questions about the strategy behind and the current state of play of COMP’s cartel pipeline, including the latest trends and experience in their investigation powers (for ex. in private homes) and their intelligence gathering activities.
