On 02 July 2026 the European Court of Justice ruled in Google Android (Case C-738/22 P).

On 03 September the European Commission published the final text of the Article 102 TFEU Guidelines on exclusionary abuses.

Over the summer many commentators have suggested that Google Android broadly reaffirms the direction already signalled in the 2024 draft Guidelines. Many nevertheless anticipate further clarification from the Commission on issues such as:

·        How will the Guidelines respond to the potentially significant expansion of the reach of Article 102 in recent judgments including Google Android? 

·        What role now for the as-efficient competitor principle in the Guidelines?

·        What about the draft Guidelines’ reliance on presumptions for certain categories of conduct? and

·        What are the practical implications of the Guidelines for dominant and potentially dominant undertakings including in digital markets?
