On o4 March, the European Commission fined
Apple €1.84 billion for abusing its dominant position on the market for the
distribution of music streaming apps to iPhone and iPad users through its App
Store.
A provisional non-confidential version of the Decision was published on 07 May.
According to the
Commission, Apple’s anti-steering provisions amount to unfair trading
conditions, in breach of the rarely used Article 102(a)
TFEU as they restrict music streaming app developers’ ability to inform and
link users to cheaper offers outside the app.
The 200+ pages
Decision raises a number of interesting applications of the EU antitrust rules
with potentially wider effects than just the affected market players.
